This Privacy Policy explains how Personal Security Products LLC, doing business as iSpyPens (“iSpyPens,” “we,” “our,” or “us”), collects, uses, discloses, and otherwise processes personal information when you visit ispypens.com, purchase our products, communicate with us, interact with our advertisements or social-media pages, or otherwise use our services (collectively, the “Services”).
This Privacy Policy does not apply to information processed independently by third-party websites, marketplaces, or platforms, such as Amazon, social-media platforms, or payment providers. Their privacy policies govern their processing.
1. Personal Information We Collect
Depending on how you interact with us, we may collect the following categories of personal information:
Information You Provide
- Contact information, such as your name, email address, telephone number, billing address, and shipping address.
- Order and transaction information, such as products viewed or purchased, order number, purchase history, returns, warranty claims, and transaction details.
- Account information, such as login credentials, saved preferences, and account activity.
- Payment information, which is processed on our behalf by payment providers. We generally receive transaction confirmations and limited payment details rather than complete payment-card numbers.
- Customer-support information, including messages, technical-support questions, diagnostic details, photographs, product reviews, survey responses, and other information you submit.
- Marketing preferences, such as email or SMS subscription choices and responses to promotions.
- Promotion and program information, such as information provided when entering a contest, giveaway, referral program, affiliate program, or other promotion.
- User-generated content, such as product reviews, photographs, videos, comments, or social-media content you submit or permit us to use.
Information Collected Automatically
When you use the Services, we and our service providers may automatically collect:
- device and browser type;
- IP address and approximate location;
- operating system;
- pages, products, and links viewed;
- referring and exit pages;
- search terms;
- dates, times, and duration of visits;
- shopping-cart activity and interactions with the Services;
- advertising identifiers; and
- information collected through cookies, pixels, tags, software development kits, local storage, and similar technologies.
Information From Other Sources
We may receive personal information from:
- ecommerce platforms, payment processors, fulfillment providers, and shipping carriers;
- marketplaces and retail partners through which you purchase iSpyPens products;
- advertising, analytics, and marketing partners;
- social-media platforms when you interact with us or choose to share information;
- affiliates and business partners; and
- publicly available sources.
2. How We Use Personal Information
We may use personal information to:
- process payments, fulfill orders, arrange shipping, and administer returns, exchanges, warranties, and refunds;
- create and manage customer accounts;
- provide customer support, troubleshooting, warranty service, and product assistance;
- communicate about orders, accounts, policies, and service updates;
- send marketing emails or text messages when permitted by law and consistent with your choices;
- personalize content, product recommendations, and advertising;
- operate, maintain, analyze, and improve the Services, products, and customer experience;
- measure the effectiveness of marketing and advertising campaigns;
- detect, investigate, and prevent fraud, security incidents, misuse, and unlawful activity;
- protect our customers, personnel, property, rights, and business operations;
- comply with legal obligations and enforce our agreements and policies;
- conduct internal reporting, auditing, research, and business planning; and
- support a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar business transaction.
We may combine information collected from different sources for these purposes.
3. Cookies and Similar Technologies
We and our service providers may use cookies, pixels, tags, and similar technologies to operate the Services, remember preferences, understand engagement, measure performance, prevent fraud, and support advertising.
You may control cookies through your browser settings and any privacy-choice tools made available on the Website. Blocking certain cookies may affect Website features. Where required, we will request consent before using non-essential cookies.
Some browsers offer a “Do Not Track” setting. Because no uniform industry standard currently governs these signals, our Services may not respond to traditional Do Not Track signals. Where required by applicable law, we will process recognized opt-out preference signals, such as Global Privacy Control, as requests to opt out of qualifying sale, sharing, or targeted advertising for the browser or device sending the signal.
3A. Recordings and Files Created With iSpyPens Products
iSpyPens products are designed to store photographs, video, audio, and related files locally on the product's memory card or on a device to which the customer transfers those files. iSpyPens does not automatically receive, access, upload, review, or store the contents of recordings merely because a customer uses an iSpyPens product.
If you voluntarily send a recording or file to Customer Support—for example, to troubleshoot a product, demonstrate a defect, or support a warranty claim—we will process that content and any associated personal information to respond to your request, protect our rights, prevent misuse, and comply with law. Do not send recordings that you are not legally permitted to disclose or that are unnecessary for the support request.
Customers are responsible for securing their products, memory cards, computers, mobile devices, and recordings; maintaining appropriate backups; deleting recordings before returning, transferring, or disposing of a device; and complying with applicable recording, privacy, surveillance, wiretap, workplace, and consent laws. This Privacy Policy does not govern how a customer independently collects or uses recordings.
4. How We Disclose Personal Information
We may disclose personal information to:
- Service providers, including ecommerce hosting, payment processing, order fulfillment, delivery, customer support, cloud hosting, IT, fraud prevention, analytics, marketing, and communications providers.
- Advertising and analytics partners, which may use cookies or similar technologies to help measure campaigns or provide personalized advertising, subject to applicable law and your choices.
- Retailers and marketplaces, when needed to fulfill or support an order placed through a third-party platform.
- Professional advisers, such as attorneys, accountants, auditors, insurers, and consultants.
- Government authorities or other parties, when reasonably necessary to comply with law, legal process, or governmental requests; enforce agreements; investigate fraud or security issues; or protect rights, safety, and property.
- Parties to a business transaction, such as potential or actual purchasers, investors, lenders, successors, or advisers in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets.
- Other parties at your direction or with your consent.
We do not disclose full payment-card information except as necessary for payment processing, fraud prevention, or as otherwise permitted by law.
We do not sell personal information for money. Certain disclosures involving advertising cookies or identifiers may be considered a “sale,” “sharing,” or “targeted advertising” under some U.S. state privacy laws. Where applicable, you may opt out as described in Section 9.
5. Marketing Communications
You may unsubscribe from marketing emails by using the unsubscribe link in the message. You may opt out of marketing text messages by replying STOP. You may still receive non-promotional communications, such as order, account, warranty, or customer-service messages.
Your mobile carrier's message and data rates may apply. Consent to receive marketing texts is not a condition of purchase.
6. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to complete transactions, maintain business and tax records, provide warranties and support, resolve disputes, enforce agreements, prevent fraud, and comply with legal obligations.
Retention periods vary based on the type of information, the nature of our relationship with you, applicable legal requirements, and operational needs. We may retain deidentified or aggregated information where permitted by law.
7. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No security method or electronic transmission is completely secure, and we cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of your account credentials and notifying us if you believe your account has been compromised.
8. Children's Privacy
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact us so we can review and, where appropriate, delete it.
9. U.S. State Privacy Rights
Residents of certain U.S. states may have rights regarding their personal information, subject to applicable law and exceptions. These rights may include the right to:
- confirm whether we process personal information and access it;
- request correction of inaccurate personal information;
- request deletion of personal information;
- obtain a portable copy of certain personal information;
- opt out of qualifying sale, sharing, targeted advertising, or certain profiling;
- limit certain uses or disclosures of sensitive personal information;
- appeal a refusal to act on a request; and
- receive equal service and pricing without unlawful discrimination for exercising privacy rights.

We may need to verify your identity and authority before completing a request. We will use information submitted for verification only as permitted by law. An authorized agent may submit a request where permitted, but we may require proof of authorization and direct identity verification.
If we deny a request and applicable law provides an appeal right, you may appeal by replying to our decision or emailing us with the subject line Privacy Appeal.
California Notice
California residents may request information about the categories and specific pieces of personal information we have collected, the sources and purposes of collection, and the categories of third parties to which information was disclosed. They may also request correction or deletion and opt out of qualifying sale or sharing.
During the preceding 12 months, we may have collected the categories described in Section 1, including identifiers, customer records, commercial information, internet or electronic-network activity, approximate geolocation, and inferences. We collect these categories from the sources described in Section 1, use them for the purposes described in Section 2, and disclose them to the recipients described in Section 4.
We do not knowingly sell or share the personal information of consumers under 16. We do not use or disclose sensitive personal information for purposes that would require a right to limit under California law unless otherwise stated at collection.
California's “Shine the Light” law may permit residents to request information about certain disclosures for third parties' direct-marketing purposes. Requests may be sent using the contact details in Section 15.
10. European Economic Area, United Kingdom, and Switzerland
If European, UK, or Swiss data-protection law applies, Personal Security Products LLC is the controller of the personal information covered by this Privacy Policy unless otherwise stated.
We process personal information based on one or more of the following legal bases:
- performance of a contract, such as fulfilling an order;
- legitimate interests, such as improving the Services, preventing fraud, and supporting customers;
- consent, where required for marketing or cookies;
- compliance with legal obligations; and
- protection of vital interests where applicable.
Depending on applicable law, you may have rights to access, correct, erase, restrict, or object to processing; receive data portability; withdraw consent; and complain to a supervisory authority. Withdrawing consent does not affect processing already undertaken lawfully.
Personal information may be transferred to and processed in the United States and other countries that may not provide the same level of protection as your home country. Where required, we use recognized safeguards for international transfers.
11. Third-Party Websites and Platforms
The Services may link to third-party websites, apps, social-media platforms, marketplaces, or integrations. We do not control their privacy or security practices. Review their policies before providing information.
12. Marketplace, Dealer, and Wholesale Orders
When you purchase an iSpyPens product through Amazon, an authorized dealer, a wholesale partner, or another marketplace, we may receive information such as your name, shipping address, email address, telephone number, order details, device identifier, or proof of purchase when needed to fulfill the transaction, provide customer service, prevent fraud, or administer a warranty.
The retailer or marketplace separately controls information it collects under its own privacy policy. We use information received from a retail partner in accordance with applicable law, our agreement with that partner, and the choices associated with the transaction. We do not use marketplace-provided customer information for unrelated independent marketing when the platform's rules or applicable law prohibit that use.
13. Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes in our practices, technology, Services, or legal obligations. We will post the updated policy and revise the effective date. We will provide additional notice when required by law.
14. Your Choices
Depending on your location and how you interact with us, you may:
- update account information through your account or by contacting us;
- unsubscribe from marketing emails or texts;
- adjust browser or cookie settings;
- use an available privacy-choice link on the Website;
- enable a recognized opt-out preference signal; or
- submit a privacy-rights request under Section 9 or 10.
